We process the personal information of adult and minor patients (with parental or guardian consent), in accordance with applicable data protection laws, including HIPAA (Health Insurance Portability and Accountability Act of 1996).

Definitions

  • Account: A unique account created for you to access our services or parts of our services.
  • Business Associates: Third parties performing certain services for Maxima Therapy that may involve handling your PHI (Protected Health Information). We ensure that Business Associates are required to comply with HIPAA by signing Business Associate Agreements (BAAs).
  • Protected Health Information (PHI): Personal information relating to your health, treatment, and care, protected under HIPAA.
  • Service: The website and mobile application that Maxima Therapy provides.
  • Usage Data: Personal information collected automatically when using our service, such as page visit duration.

Roles

Parent/Guardian:

If the appointment is being scheduled on behalf of a minor, your consent is required to process the minor’s personal information. You could access the minor's account, view appointments, and request to change the child’s personal information or exercise rights concerning PHI on their behalf.

Patient:

We collect and process patient’s PHI to facilitate appointments and communication with their therapists. You can access, amend, and request restrictions on your PHI or minor under your supervision.

Therapist:

Therapists access patients’ PHI to provide care. Our strict privacy and security policies, which comply with HIPAA requirements, protect all PHI therapists handle within our web and mobile applications.

Information We Collect

Account Registration and Maintenance (Parent/Guardian):

We collect personal information such as your name, contact details (e.g., phone, address), and other information required to manage your child’s care and appointments.

Account Registration and Maintenance (Patients):

We collect personal information such as your name, contact details (e.g., phone, address), and health-related information necessary for managing therapy appointments, as well as your calendar and session notes.

Account Registration and Maintenance (Therapists):

We collect professional contact details (e.g., name, phone, address, and credentials) to manage patient appointments.

Uses and Disclosures of Your PHI

1. Uses and Disclosures for Treatment

We will use and disclose your PHI to provide treatment and services. This may include:

  • Sharing your PHI with therapists involved in your care to review medical records, symptoms, and treatment responses.
  • Using your PHI for procedures or medical history that are part of your treatment plan.

2. Uses and Disclosures for Payment

We may use and disclose your PHI to:

  • Submit claims to your health insurance provider and/or Regional Center for payment of services rendered.
  • Generate invoices or bills for therapy services received.

3. Uses and Disclosures for Healthcare Operations

Your PHI may be used for purposes related to our healthcare operations, including:

  • Clinical reviews and treatment assessments to improve the quality of care.
  • Business operations, accreditation, and internal audits.

4. Business Associates

Certain aspects of our services are performed by Business Associates. We require these Business Associates to sign Business Associate Agreements (BAAs) and comply with HIPAA standards. Minimum Necessary Standard: We limit the PHI shared with Business Associates and others to the minimum necessary to accomplish the intended purpose.

Patient Rights Under HIPAA

  • Right to Access and Receive Copies: You have the right to inspect and receive a copy of your medical records, including electronic copies.
  • Right to Amend: You have the right to request corrections or amendments to your medical records if you believe they are inaccurate or incomplete.
  • Right to Request Restrictions: You have the right to request restrictions on the use or disclosure of your PHI. We are not required to agree to every request, but if we do, we will comply.
  • Right to an Accounting of Disclosures: You have the right to request an accounting of disclosures of your PHI made by us, including those made for purposes other than treatment, payment, or healthcare operations.
  • Right to Request Confidential Communications: You can request that we communicate with you in a particular manner (e.g., only through mail or phone).
  • Right to File a Complaint: If you believe your privacy rights have been violated, you can file a complaint with us or with the U.S. Department of Health and Human Services. To file a complaint with us, contact our Privacy Officer at privacy@maximatherapy.com. You will not be penalized for filing a complaint.

Breach Notification

In the event of a breach involving your unsecured PHI, we will notify you without delay, in compliance with HIPAA’s Breach Notification Rule. This notification will include details of the breach and steps you can take to protect yourself from potential harm.

Marketing and Fundraising Communications

We may use your contact details to send you marketing or fundraising communications. However, you have the right to opt out of receiving such communications. To opt out, please contact info@maximatherapy.com.

How We Protect Your Information

We implement administrative, technical, and physical safeguards to protect your PHI against unauthorized access, use, or disclosure. These measures comply with the HIPAA Security Rule and include encryption, access control, and regular audits.
